  • Regulation (EU) 2024/1689 (the EU Artificial Intelligence Act) prohibits placing on the market, putting into service, or using certain AI practices listed in Article 5.
  • Article 5(1)(c) prohibits AI systems that evaluate or classify natural persons or groups over a period of time based on social behaviour or known, inferred or predicted personal or personality characteristics, where the resulting social score leads to detrimental or unfavourable treatment in unrelated social contexts, or to treatment that is unjustified or disproportionate to the gravity of the behaviour.
  • The official recitals state that this prohibition should not affect lawful evaluation of natural persons carried out for a specific purpose in accordance with Union and national law.
  • The European Commission's 2025 guidelines on prohibited AI practices treat social scoring as a distinct prohibited practice, not as a general ban on all scoring or ranking.

Human Reserve can be created by refusing a capable task, not only by supervising it.

A DENY classification is still a delegation decision. It locates authority in the institution that withholds permission.

Delegation boundary
